The General Terms have been prepared in accordance with Law 34/2002 on E-commerce and Information Society Services, Law 7/1998 on General Terms of Business and other relevant legal regulations.
NEON BOOTS informs its users that the process for purchasing articles is that described in the General Terms of Business and instructions indicated on-screen whilst a user is browsing. The User therefore understands and accepts such processes as a necessary step to access the products and services offered on the website.
Any changes and/or corrections to the information provided by Users whilst they browse should be made in accordance with the instructions given on the site.

Products for sale - purchasing system

The User shall consult, register and accept these terms before making on-line purchases and understands that access to the shop and the purchase of any of the products on sale implies that they have accepted the General Terms of Business. The username and password given by the User to NEON BOOTS, which identify each user and enable him/her to access the products and services on the website, are personal and cannot be transferred.

Users are warned that the colour of garments viewed on-screen may differ as a result of the PC screen and that no guarantee can be made that the colours seen are the exact same colours as the garments themselves.
Notwithstanding the foregoing, NEON BOOTS makes every effort to ensure that the colours viewed on-line are as close as possible to the colours of the actual garments.
1º Click on the product you want to buy to see full details. On the product page, select size (when several applies) and quantities. Then click on the ‘Add to bag’ button.
2º Click on ‘Your Bag’ to check the products you want to buy. To add more products, please go to ‘Collection’.
3º Once you have checked the product or products selected, just click on ‘Proceed to checkout’. In the comment box that will appear, please include any details/special requests about your order, for example, your phone number in case we may need to contact you.
4º You will be redirect to the Paypal page, where you will be asked about your card details, billing address and email. You can pay with your Paypal account or with your credit card.
5º Click ‘Continue’ and then you will be asked if you wish shipping address to be different than billing address, for example, if it’s for a gift.

Delivery process, costs & period
NEON BOOTS uses nationally and internationally known courier services to send out their orders to customers. The home delivery date depends on the product purchased and the delivery zone. Orders delivered within the European Union usually takes between 3-5 working days depending on destination.
Home deliveries to addresses outside European Union will take several weeks.
For special requests like stamping your Neon Boots, delivery takes an additional week.
Delivery deadlines stated are for guidance only.
Delivery costs will appear on the website before you confirm your order. There are no costs if shipping to the European Union
A delivery is completed when the product is handed over to the Customer by the courier service and the recipient signs to confirm receipt of the delivery. The recipient should check the products upon receipt and report any complaints or comments that could be justified.
Exchanges & refunds
If a customer wishes to return/Exchange an article purchased, they should always contact previously Neon Boots at email@example.com
A return/refund/change does not apply in case you requested to have your boots stamped, except if there is a manufacturing defect, in that case the product will be replaced for a new one.
If The Customer is not satisfied with the products purchased once in receipt of them, he/she has the right to exchange (size, colour or for another article of the same value) or return the product within a period of thirty (30) days from when he/she receives the products upon prior communication with NEON BOOTS within this period of time. The Customer shall be refunded the price paid for the original product.
The Customer may exchange or return the article purchased provided that the product has not been opened or used and the original seals or packaging have been kept. Refunds shall only be allowed if the product is in perfect condition with its original packaging and has not been used. If a client wishes to return a product, they should fill in the returns form on this website and follow the instructions. In cases such as these, the Customer must pay the direct return transportation costs.
If a customer outside Spain wishes to exchange a product, NEON BOOTS shall pay for the delivery cost of the articles to be exchanged (In European Union, until a quantity depending on country). If the customer wishes to exchange or return an article that has already been exchanged, the return costs and any return costs incurred in subsequent exchanges shall be paid for by the customer. NEON BOOTS will not accept returns paid for on delivery in these cases.
If a customer outside Spain wishes to return a product, customer shall pay for the delivery cost of the articles to be returned. NEON BOOTS will not accept returns paid for on delivery in these cases.
Returns due to defects caused during transportation or a delivery error
If it is clear to see upon delivery that a product has been damaged during transportation without having to touch the delivery or product packaging, or it is obvious that the wrong product has been delivered, the Customer should record the incident on the delivery note and inform NEON BOOTS using the returns form provided for this purpose on the website, by email to hello@neonboots. We shall let the customer know how to proceed within the 24 hours following receipt of the product in order to return the damaged article or articles, exchange it/them for another item or get a refund.
Defects that occur during transportation and which can only be seen once the product has been unwrapped should be reported within 24 hours of receiving the order as described above. The information provided should include the order number, a description of the damage to the product and a request for either an exchange or a refund. NEON BOOTS shall look at the product and will decide whether the customer is entitled to an exchange. Refunds shall not be given on products that are not in the same condition as when received or which have been opened and also used. The refund or exchange shall be made as soon as possible and always within the 30 days following the date on which we sent an email confirming that the damaged product would be refunded or exchanged.
In such cases, NEON BOOTS shall refund the purchase within a maximum period of 30 days from when the request for a refund was received from the User. The refund shall be made using the same payment method as was originally used, or via bank transfer to the account stated by the User.

If there is a manufacturing defect, the article purchased may be returned provided that it has not been used and the original packaging has been kept. Refunds shall only be allowed if the product is still in its original packaging and has not been used.
The whole order should be returned, including all accessories and the product’s original packaging. Once the product has been received, NEON BOOTS shall look at it and will decide whether the customer is entitled to an exchange. Refunds shall not be given on products that are not in the same condition as when received or which have been opened and also used. The refund or exchange shall be made as soon as possible and always within the 30 days following the date on which we sent an email confirming that the faulty product would be refunded or exchanged.
If it is obvious upon delivery that a mistake has been made with the goods delivered without having to open the packaging, the Customer should record this error on the delivery note and inform NEON BOOTS using the form provided for this purpose on the website, by email to firstname.lastname@example.org. We shall tell the customer what action to take within the 24 hours following receipt of the goods in order to return the product or products in question and receive an exchange.

The above does not affect the user’s statutory rights.
The products purchased on this website shall be paid for by the User on-line using a credit card or the PayPal system. The User must pay the full amount of the products purchased and an order shall be deemed valid once payment confirmation has been received from the relevant bank.
If a credit or debit card is used, once the details provided have been checked, the charge shall be made on-line in real time using the relevant bank’s payment gateway. Credit cards are subject to the relevant checks and authorisations by the issuing bank, meaning that if such bank does not authorise payment, NEON BOOTS is not responsible for a delayed or unsuccessful delivery.
Circumstances beyond our control
If either of the parties is unable to fulfil its duties as a result of circumstances beyond their control, neither party shall be held responsible. Compliance with such responsibility shall be delayed until the circumstances beyond our control have been resolved, meaning that if such circumstances were to continue, either party may ask for the agreement to be terminated without incurring any kind of penalty.
The product prices displayed on the website include VAT and all other applicable taxes (Only EU). The prices shown are always current, except if there is a misprint. Offers shall be duly highlighted on-screen.
All purchases delivered within European Union member countries are subject to VAT.
Purchases delivered to non-European Union member countries are exempt from VAT.
The user’s duties
The User agrees to accept all the provisions and terms included in these General Terms of Business and to keep their website username and password confidential at all times.
Likewise, the User agrees to provide accurate information at all times when registering and placing an order and to always keep this information updated.
The User agrees to help with the delivery by providing an address to which the order may be delivered. NEON BOOTS is not responsible in any way if a User’s order is delayed or cannot be delivered due to the User not having provided a delivery address.

Applicable legislation & relevant jurisdiction
Purchases made using the www.neonboots.com website are subject to Spanish legislation.
In the event of conflict or discrepancy when interpreting or applying these terms of business, the courts and tribunals dealing with such matters shall be those established by the applicable legislation within the relevant jurisdiction, such jurisdiction being, in relation to consumers, the location where the obligation is to be met or the purchasing party’s domicile.
If the buyer lives outside Spain, both parties expressly waive their right to any other jurisdiction and submit to the Courts and Tribunals in Madrid (Spain).
